Process:

  • Sale Agreement: A written agreement is entered into between the seller (current owner) and the buyer (new owner) outlining the terms and conditions of the property transfer. This agreement may be in the form of a contract or a memorandum of sale.
  • Conveyancing: Conveyancing is the legal process of transferring ownership of the property. It involves various tasks such as property searches, title investigations, drafting legal documents, and coordinating the financial aspects of the transaction.
  • Transfer Deed: The Transfer Deed, also known as the Transfer of Ownership document or TR1, is a legal document that transfers the legal title of the property from the seller to the buyer. It contains details of both parties, the property description, and any relevant conditions or restrictions.
  • Land Registry: Once the Transfer Deed is signed and completed, it is submitted to the Land Registry. The Land Registry is responsible for maintaining records of property ownership in England and Wales. The Transfer Deed is registered with the Land Registry, and the new owner’s details are officially recorded.
  • Stamp Duty Land Tax (SDLT): If the property being transferred has a value above a certain threshold, the buyer may be required to pay Stamp Duty Land Tax. This tax is calculated based on the purchase price of the property and must be paid to HM Revenue & Customs.
  • Change of Legal Ownership: Once the transfer is registered with the Land Registry and any applicable taxes are paid, the legal ownership of the property is officially transferred to the new owner. They become the registered owner of the property and have the legal rights and responsibilities associated with it.
